Article 1 Applicability

• The Terms of Service shall apply to all relationships between the user and our organization concerning the use of the Service.
• In addition to these Terms of Service, our organization may apply various rules and regulations regarding the use of the Service (hereinafter referred to as "Individual Regulations").
• These individual provisions, regardless of their name, shall constitute a part of these Terms and Conditions. In the event of any inconsistency between the provisions of these Terms and Conditions and the individual provisions of the preceding Article, the individual provisions shall take precedence unless otherwise specified in the individual provisions.

Article 2 Registration

• Registration for this service is completed when the applicant agrees to the Terms and Conditions, applies for registration in the manner prescribed by the Organization, and the Organization approves the application.
• Users who have not registered to use the service are also considered to have agreed to the Terms of Service.

Article 3 Usage Fees and Payment Methods

• As compensation for the paid portion of the Service, the User shall pay the fees separately determined and indicated by the Organization in the manner designated by the Organization.
• In the event the User is late in paying the usage fee, the User shall pay a late fee at the rate of 14.6% per annum.

Article 4 Prohibitions

In using the Service, users are prohibited from the following acts

• Acts contrary to laws and regulations or public order and morals
• Conduct related to criminal activity
• Acts that infringe on copyrights, trademarks, or intellectual property rights contained in the Service
• Any act that destroys or interferes with the functioning of the Organization's, another User's, or a third party's server or network
• Commercial use of information obtained through this service
• Acts that may interfere with the operation of this service
• Unauthorized access or attempts to gain unauthorized access
• Collecting or accumulating personal information about other users
• Use of the Service for any unauthorized purpose.
• Acts that cause disadvantage, damage, or discomfort to other users or third parties
• Impersonating another user
• Advertising, solicitation, or sales activities on the Service that are not authorized by the Organization
• Aiming to meet someone you do not know
• Acts of providing benefits directly or indirectly to antisocial forces in relation to this service.
• Other activities that the organization deems inappropriate.

Article 5 Provision of this Service

The Organization may suspend or discontinue the Service, in whole or in part, without prior notice to the User, for any of the following reasons

• When performing maintenance, inspection, or updating of computer systems, etc. related to this service
• When it becomes difficult to provide this service due to force majeure such as earthquake, lightning, fire, power outage, or natural disasters.
• In the event of an accident involving a computer or telecommunication line
• In other cases where it is deemed difficult to provide the information in a manner prescribed by the Organization.

The Organization shall not be liable for any disadvantage or damage incurred by the User or any third party due to the suspension or interruption of the Service.

Article 6 Restrictions on Use and Cancellation of Registration

The Organization may restrict a User's use of the Service, in whole or in part, without prior notice, if the User falls into any of the following categories

• Violation of any of the provisions of these Terms and Conditions
• When it is found that there is a false fact in the registration information
• In the event of default in payment of fees and other obligations
• If you have not responded to our organization's communications for more than 3 months
• When there has been no use of this service for more than one year since the last use of this service
• In any other case in which the Organization deems the use of the Service to be inappropriate.

The Organization shall not be liable for any damages incurred by the user and our organization as a result of restrictions made by the Organization under this Article.

Article 7 Withdrawal from Membership

You may cancel your registration by following the procedures established by the Organization.

Article 8 Disclaimer of Warranty and Disclaimer of Liability

• The Organization does not warrant, expressly or impliedly, that the Service will be free from defects in fact or law (including, but not limited to, judgments concerning safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs, or infringement of rights).
• The Organization does not warrant, expressly or impliedly, that the Service will be free from defects in fact or law (including but not limited to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security or other determinations, errors or bugs, or infringement of rights) in a manner determined by the Organization. The information is provided "as is" and without warranty of any kind, either express or implied.
• Even in the case of the proviso of the preceding paragraph, the Organization shall not be liable for any damage arising from special circumstances (including cases in which the Organization or the User foresaw or could have foreseen the occurrence of the damage) among damages caused to the User due to the negligence (excluding gross negligence) of the Organization or tortious acts. In addition, the Corporation shall not be liable for any damages caused by the negligence of the Corporation. In addition, compensation for damages incurred by a User due to the Organization's negligence (excluding gross negligence) or tort shall be limited to the amount of the usage fee received from the User for the month in which the relevant damage occurred.
• The Organization shall not be responsible for any transactions, communications, or disputes between a User and another User or a third party in connection with the Service.

Article 9 Change of Service Contents, etc.

The Organization reserves the right to change, add, or discontinue the Service with prior notice to the User, and the User agrees to such changes, additions, or discontinuation.

Article 10 Changes to Terms of Service

• The Organization reserves the right to modify these Terms and Conditions without requiring individual user consent in the following cases
• When changes to these Terms of Service are compatible with the general interests of the user.
• The modification of the Terms of Service is not contrary to the purpose of this Service Agreement and is reasonable in light of the necessity of the modification, the reasonableness of the content of the modification, and other circumstances pertaining to the modification.
• The Organization will notify Users in advance of any changes to these Terms and Conditions in accordance with the preceding paragraph, as well as the contents of the revised Terms and Conditions and the effective date of such changes.

Article 11 Handling of Personal Information

The Organization shall handle personal information obtained through the use of the Service in accordance with the Privacy Policy set forth separately.

Article 12 Notices or Communications

Notices or communications between the user and our organization shall be made in the manner prescribed by our organization. Unless a user notifies the Organization of a change in his/her contact information in a manner determined separately by the Organization, the Organization will assume that the currently registered contact information is valid and will send notices or communications to that contact information.

Article 13 Prohibition of Assignment of Rights and Obligations

The User may not assign his/her contractual status or rights or obligations under this Agreement to any third party or offer them as security without the prior consent of the Organization.

Article 14 Governing Law and Jurisdiction

• These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
• Any and all disputes related to the use of the Service (including court mediation procedures) shall be subject to the exclusive jurisdiction of the Sapporo Summary Court or the Sapporo District Court as the court of first instance.
